  • Chapter 13 bankruptcy, also called reorganization of debt or a “wage earner plan,” requires the debtor to pay back a portion determined (often a small percentage) of the debts over 3 to 5 years. The remaining debt is forgiven if the person has made payments. Chapter 13 is often used to protect a home from foreclosure. In certain circumstances we can modify or eliminate second and third mortgages, which is commonly called strip down or cram down.
