We offer comprehensive elder law legal services. We assist with short-term or urgent legal needs such as guardianship petitions and litigation regarding advance health care directives or powers of attorney. We also develop long-term relationships with our elder law clients — usually through the estate planning process — to create asset protection strategies for their later years and for future generations.
Estate Planning and Asset Protection
The goals of estate planning are to protect your assets during your life and after your death. Proper estate plans not only include wills and trusts, but also powers of attorney and living wills that specify our clients' wishes should they become incapacitated.
Health Care Planning, Directive and Guardianships
Don't leave your decisions to strangers or the impersonal actions of the courts, and force your family to make difficult health care decisions without adequate guidance. We can advise you in drafting advance health care directives that convey your wishes for medical situations when you are incapacitated and unable to make your own decisions.
Another important piece of our elder law practice involves counseling clients on how to plan for future health care needs via Medicaid planning and advance preparation of Medicaid qualification strategies.
Special Needs Trusts
Add new paragraph--to be supplied by Mr. Klein
Guardianships are a legal instrument that may be used on the behalf of people who have become incapacitated and do not have powers of attorney in place. If an elderly relative becomes unable to make financial or medical decisions, a relative or family friend may file a guardianship petition to obtain the formal legal power to make decision on behalf of the incapacitated person.
Estate Administration and Estate Litigation
In addition to estate planning before death, Klein & Radol handles probate and estate administration for executors after the death of a loved one. As a firm of trial lawyers, we also offer capable representation to litigants in estate litigation such as will contests.
